1. Acceptance of Terms

By accessing and using Certigo's platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. Your use of the platform is also governed by our Privacy Policy, which is incorporated into these terms by reference. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Use License

Permission is granted to access and use the materials and tools on Certigo's platform in accordance with your subscription plan. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify, copy, or redistribute platform materials or tool outputs for resale
• Use the platform for any unlawful purpose
• Attempt to decompile, reverse engineer, or extract source code from the platform
• Remove any copyright or other proprietary notations
• Share your account credentials or allow unauthorized access to your account

3. Service Description

Certigo provides a dangerous goods compliance and training platform. Our services include:

• Placard Calculator — determines required placards for dangerous goods shipments based on TDG, 49 CFR/PHMSA, and international regulations
• SDS Manager — upload, store, parse, and manage Safety Data Sheets with AI-assisted data extraction and translation
• UN Number Search — search and reference dangerous goods classifications, packing groups, and shipping requirements
• Shipping Document Generator — create compliant shipping documents for dangerous goods transport
• DGX AI Assistant — AI-powered regulatory chat assistant for dangerous goods compliance questions
• Driver Mode — mobile-optimized compliance reference for drivers transporting dangerous goods
• Tunnel Calculator — calculate tunnel restriction codes for dangerous goods transport
• Training Courses — online dangerous goods training with certification (TDG, 49 CFR awareness)
• Regulatory News Feeds — curated updates from Transport Canada, 49 CFR/PHMSA, and other regulatory bodies
• SDS Terminal — a shared-tablet (Terminal) mode that lets on-site workers scan, search, or ask for Safety Data Sheets offline at a facility
• SDS Creator — author and maintain GHS/WHMIS-formatted Safety Data Sheets

4. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to:

• Provide accurate and complete registration information
• Keep your account information up to date
• Accept all risks of unauthorized access to your account
• Notify us immediately of any unauthorized use of your account
• Not share your account with other individuals

5. Payment Terms

Certigo offers a range of access models depending on the product. Some tools include a free tier, and new company accounts may be offered a free trial with full access to platform tools for a limited period. Subscription fees (for example, for the SDS Manager) are billed in advance on a monthly or annual basis and auto-renew at the end of each billing cycle unless cancelled. Certain items — including training courses and course licences — are sold as one-time purchases through our marketplace rather than as subscriptions. All payments are processed securely through Stripe. You may cancel a subscription at any time through your account settings; cancellation takes effect at the end of the current billing period, and downgrading a plan may reduce the features or capacity available to you. We reserve the right to change our pricing with 30 days' written notice. All fees are non-refundable except as required by applicable law.

6. Intellectual Property

All content, features, and functionality of the platform — including but not limited to software, text, graphics, logos, training materials, and compliance tools — are owned by Certigo or its licensors and are protected by international copyright, trademark, and other intellectual property laws. Regulatory data sourced from public agencies (Transport Canada, PHMSA, and relevant regulatory agencies) remains the property of the respective agencies.

7. User Content & Shared SDS Library

You retain ownership of the documents, Safety Data Sheets (SDS), and other content you upload to the platform ('User Content'). By uploading User Content, you grant Certigo a non-exclusive, worldwide license to host, store, process, parse, translate, and display that content as needed to operate the platform and provide the services to you. You represent that you have the right to upload your User Content and that doing so does not infringe any third-party rights.

• Shared SDS library — to help all customers find safety information faster, an uploaded SDS may be added to Certigo's shared SDS library, where its product name, manufacturer, and parsed safety sections become discoverable to other Certigo customers searching for the same chemical; your inventory, quantities, internal notes, and account details are never shared
• Opt out anytime — you can mark any SDS as private from its page to exclude it from the shared library, and you can disable shared-library contribution for your organization in your settings
• Manufacturer Safety Data Sheets are published by chemical suppliers and are generally not proprietary to any single customer; sharing them improves data quality and coverage for all users
• You are responsible for ensuring your uploaded content is lawful and for not uploading confidential or personal information that you do not wish to be processed as described

8. Compliance Tools — Disclaimer and User Responsibility

Certigo's compliance tools (Placard Calculator, SDS Manager, UN Number Search, Shipping Document Generator, Tunnel Calculator, and Driver Mode) are designed to assist with dangerous goods compliance but are informational aids only. While Certigo strives for accuracy and regularly updates its tools to reflect current regulations, Certigo does not guarantee that tool outputs are error-free, complete, or reflective of the most current regulatory requirements. The user and/or their company bear full responsibility for verifying all tool outputs against applicable regulations — including but not limited to the Transportation of Dangerous Goods Regulations (TDG), 49 CFR/PHMSA (49 CFR), and applicable international regulations — before relying on them for any compliance decision. Certigo's tools do not constitute professional regulatory advice, legal counsel, or a substitute for qualified dangerous goods personnel. Users must ensure their own compliance with all applicable laws and regulations. Certigo shall not be held liable for any fines, penalties, damages, or losses arising from decisions made based on tool outputs.

9. AI-Powered Features

Certain platform features are powered by artificial intelligence (Google Cloud AI — Gemini, Vertex AI, and Document AI), including the DGX AI Assistant, SDS document parsing and translation, hazmat document scanning, and compliance validation. AI outputs are supplementary and may be inaccurate, incomplete, or outdated. Users must not rely solely on AI-generated content for compliance decisions. All AI-generated outputs should be reviewed and validated by qualified personnel before use. Certigo does not warrant the accuracy, completeness, or reliability of any AI-generated content.

10. Training and Certification

Certigo offers online dangerous goods training courses leading to certification. By enrolling in a course, you agree to:

• Complete all course materials and examinations honestly and without external assistance
• Not share exam questions, answers, or course content with others
• Acknowledge that a minimum passing grade (typically 80%) is required for certification
• Understand that certificates have a defined validity period and must be renewed before expiration
• Acknowledge that employers bear responsibility for ensuring their employees receive adequate and appropriate dangerous goods training as required by applicable regulations

11. Limitation of Liability

To the maximum extent permitted by law, Certigo shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service, including but not limited to damages arising from reliance on tool outputs, AI-generated content, or compliance calculations. Certigo's total liability for any claim arising from or related to these terms shall not exceed the amount you paid to Certigo in the twelve (12) months preceding the claim.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Quebec.

13. Termination

We may suspend or terminate your access to the platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the platform ceases immediately. Provisions of these terms that by their nature should survive termination (including disclaimers, limitation of liability, and intellectual property) shall survive.

14. Modifications to Terms

Certigo reserves the right to modify these Terms of Service at any time. We will notify you of material changes by posting updated terms on this page and updating the 'Last updated' date. Your continued use of the platform after changes are posted constitutes acceptance of the modified terms. For significant changes, we may also notify you by email.

16. Language

These Terms of Service are made available in English, French, and Spanish. Certigo operates in Quebec, Canada, where both French and English are used; a French-language version of these terms is provided to users in Quebec in accordance with the Charter of the French Language.
